2. Purpose
AudySpark is a web page analysis tool. It produces a scored diagnosis of a page's ability to convert, together with prioritised fixes. The service is delivered online, with nothing to install.
3. What the service covers
- Free audit
- A first partial diagnosis is available without an account or a card, within the number of scans allowed per period.
- Full report
- Unlocking a full report is a one-off purchase. It gives access to the detailed report and to one free re-audit of the same page within 30 days of purchase.
- Subscriptions
- Monthly plans open an audit allowance and additional features, per the pricing page as displayed at the time you subscribe.
4. Account and access
Access to a purchased report and to the dashboard is granted through a sign-in link sent to your email address. You are responsible for the confidentiality of your inbox and of the access it grants. A cap on link requests per hour protects the service against abuse.
5. Pricing and payment
Prices are shown on the pricing page, in euros or dollars depending on your selection, and are due at the time of order. Payment is processed by Stripe: we have no access to card data. An invoice is issued for every payment.
6. Right of withdrawal
The full report is digital content supplied immediately after payment. By ordering it you expressly request immediate performance and acknowledge that you lose your right of withdrawal once the report is delivered, under Article L221-28 13° of the French Consumer Code. A commercial gesture remains possible where delivery failed or an obvious error occurred.
7. Cancelling a subscription
A subscription can be cancelled at any time, without reason and without fee. Access remains open until the end of the period already paid for; no pro-rata refund is made. No minimum commitment period applies.
8. Acceptable use
You undertake to audit only pages you operate or hold a mandate for. The following are prohibited:
- Circumventing rate limits, quotas or access controls.
- Automating bulk submissions outside the plans designed for that purpose.
- Reselling or redistributing reports as a competing product.
- Submitting URLs that lead to unlawful content.
- Attempting to extract our prompts, models or analysis grids.
A breach may lead to suspension of access, after a warning where circumstances allow one.
9. Scope of the reports
A report is an automated analysis, produced at a point in time from the public content of the page. It is a methodical opinion, not legal, financial or medical advice, and it guarantees no commercial outcome. Decisions taken on the basis of a report are yours alone. Audits published as examples on third-party brands are performed on our own initiative and are commissioned by no one.
10. Intellectual property
The platform, its analysis method, its grids and the layout of the reports remain our property. You keep ownership of the content you submit. Buying a report grants you a right to use it internally and with your clients, with no right to resell it as a standalone product.
11. Availability
The service is provided with no service level commitment. Interruptions may occur for maintenance, from an incident, or because of a third-party provider. We work to reduce and report them, without being able to rule them out.
12. Liability
Our liability is limited to direct and foreseeable damage, capped at the amounts you paid over the last twelve months. No limitation applies in case of gross negligence, wilful misconduct or personal injury. Mandatory consumer protection rules remain fully applicable.
13. Personal data
How your data is processed is described in the privacy policy. Cookies are described in the cookie policy.
14. Changes to these terms
These terms may be amended. The version applicable to an order is the one in force when that order is placed. The last-updated date appears at the top of the page.
15. Governing law and disputes
These terms are governed by French law. In case of a disagreement, please write to us first so we can look for an amicable solution. Failing agreement, the dispute falls to the competent courts; if you are a consumer, you keep the right to bring the matter before the court of your place of residence and to use the European online dispute resolution platform.
